Things to Know About Car vs. Pedestrian Accident Cases
When an individual is struck by a vehicle, the injuries often prove to be severe. These usually include broken bones, internal trauma, spinal cord injuries, TBI, and wrongful death in some extreme cases. After a pedestrian accident, it is crucial to determine who was liable for the incident and who should be held accountable for damages incurred. If the driver is at fault, a personal injury or wrongful death claim may be brought against them and their insurance carrier.
There are some situations where the other side has insufficient liability insurance limits or none. An experienced Concord pedestrian accident attorney can help an injured individual, or a family of a decedent, determine all potential sources of financial recovery during an investigation. This includes looking at the pedestrian’s or their household member’s auto insurance policy to determine whether their uninsured and underinsured motorist coverage may come into play. An attorney will also investigate whether punitive damages may be sought from a negligent driver if DUI was a contributing factor to the incident.
Because a two-year statute of limitations applies to accident cases, injured parties and families of lost loved ones have a limited amount of time to file a lawsuit in civil court. It is essential to act quickly to protect your rights. Failure to meet the deadline may result in the court’s dismissal of the case.
