Texas Hospital Wins Dismissal of Patient’s Burn Injury Lawsuit

A woman who sued a hospital for allegedly causing her severe burns failed to convince a Texas appeals court that her claim should have been filed under the state’s torts law instead of the medical malpractice law.

Tiffine Vanderbilt sued University Medical Center in January 2020. She alleged she had been injured with heating pads placed on her back during her recovery from giving birth by Caesarian section. Vanderbilt allegedly suffered second degree burns and permanent disfigurement.

Vanderbilt alleged negligence pursuant to the Texas Tort Claims Act, the Texas Court of Appeals, Seventh District said.
