Richmond U. Medical Center Must Face Wrongful Death Suit

By Mike Curley (June 17, 2022, 9:48 AM EDT) — A New York appeals court has revived a man’s claims that Richmond University Medical Center staff delayed diagnosis and treatment of his wife’s cervical cancer, leading to her death, saying that there is a triable question of fact about whether they should have acted sooner.

In an opinion filed Wednesday, a four-judge Appellate Division panel reversed a summary judgment favoring RUMC in Paul Pezulich’s suit, saying Pezulich’s expert was able to rebut the hospital’s argument that its staff were acting under the direction of a private physician.
