A lawyer in Mississippi doesn’t have to face a legal malpractice action brought by a former client who accused the attorney of flubbing a suit against Select Specialty Hospital, a state appeals court held Tuesday.
Cynthia McGilberry hired Lisa Ross to represent her in the federal suit against the hospital, and Ross failed to file a response to a summary judgment motion following discovery. The court threw out the underlying suit, and McGilberry filed the legal malpractice claim against Ross alleging professional negligence.
The Hinds County Circuit Court granted Ross’ motion for summary judgment in the case.
