Minnesota Life Not Liable for Payout in Death Linked to Drug Use

Minnesota Life Insurance Co. isn’t liable for payment of an accidental death claim to the widow of a man who died trying to cross a busy freeway on foot because he was intoxicated with methamphetamine and cocaine, a Texas state appeals court ruled Wednesday.

Although it was her burden to prove that the life insurance policy’s intoxication-exclusion didn’t apply, LaRae Walker offered no evidence to explain why her husband might have otherwise attempted to cross the freeway or that drug use hadn’t impaired his mental faculties, the Texas Court of Appeals, Third District said.
