A lawyer escaped a legal malpractice lawsuit after a federal judge in Arkansas found that the plaintiff wasn’t able to meet his burden of showing that he would have succeeded in the underlying medical malpractice action.
When Theodore Thompson’s brother, George Anderson, died of surgical complications, Thompson wanted to hire an attorney to help file the medical malpractice lawsuit. He called Willard Proctor Jr. of Proctor & Associates, and Thompson and his siblings paid Proctor for a pathology report, according to Thompson.
